The article is wrong. If Dumervil pulled a gun without it being self defense with another individual pulling a gun on him, he will serve 10 years. Florida has extremely strict gun laws (Lived there for 7 years). They implement a set of mandatory prison sentences regarding firearms and its called "10-20-Life"

Pull a gun, 10 years
Fire a gun, 20 years
Shoot someone, 25-Life

Thanks I'm glad someone from Florida gave us an accurate account oF florida law. A question if said defendant only showed the gun(was in his pants) does that constitute pulling a gun. Thanks

I don't think "flashing" a gun is considered pulling a gun, therefore if thats the case then he will not face the same punishment. You could "accidentally" flash a gun but you can't "accidentally" pull one.

No, you're not allowed to pull a gun and shoot someone. What does any of this have to do with Plax, who was showing off in a bar waving a gun and shot himself. Not seeing what this has to do with defending yourself or being a target. It's fu(king idiots like this that keep the left armed. The moron could have killed someone and is an example why people shouldn't be allowed to carry, because most are too stupid to carry.

What ended up happening is that the case was reduced to misdemeanors after some lawyer finagling. Doing A doesn't automatically mean B charges.

Quoting misdemeanor statutes for actions that are clearly aggravated assault/attempted manslaughter just makes this conversation stupid.

Plax was not showing off his gun. It was in his pants and it fell down his pants leg and was accidentally discharged. Now if he was allowed to carry a register concealed weapon for protection.(He might have had it in a holder- making it safer for a lot of people) If you used Jayson Williams(nets) you would be correct as he was showing off his gun. (that was a lot different than Plax situation)

You think Joe crackhead cares about NY tough gun laws. All he cares about getting money to support his habit. So you shouldn't be allowed to carry a register weapon for your protection and your fAMILY. (what they don't have any rights)

You remember Bernard Goetz . The man was robbed 27 times. The thugs admitted they were going to target him because he was an easy mark. Well enough was enough. This time MR Goetz was ready- had a gun for protection. Only one of those thugs he shot is not dead or in jail- was the guy he paralyzed.
