But, the penalty i.e. The State can tax you if you do not have Insurance, survives, as does the rest of the bill. Effectively meaning the entire bill suirvives in practice, giving the Dems the new power they wanted (a pwoer which WILL be used again I guarantee it), and giving the (R) yet another massive Supreme Court loss following the AZ decision. Isn't "taxing" you if you don't buy something the same as requiring you to buy something? |

The difference is semantics. They can't make you buy it as Law. But they can tax you $1,000,000,000 a day if you don't buy it, as a tax. Which means they can make you. That's the Law. /shrug. Often it's semantics that rule the day. In a system where our President has free reign to not enforce laws he simply doesn't like or agree with, and now the Federal Govt. has teh power to compel you to buy whatever they want you to buy, against your will, or face any tax they decide to levy against you, well....it is what it is, isn't it. A stunningly huge victory for (D) and Social Welfareism/Collectivism/State Power over the Individual today. Mandate was declared unconstitutional but court maintains that Federal Government has the power to tax consumers that don't comply. Mandate is replaced with a tax penalty.

The Court agreed that the mandate would not have passed the commerce clause test, but does stand up as a tax, which even Obama insisted it was not.
Pure, utter garbage. |

I hope, one day, that if (R) gets power back, they pass a Gun Ownership Mandate. You, the individual, must own 10 Federally Registered Guns, or face a tax.
And a Voter ID mandate, that you the individual must purchase a Voter ID fromt he State, or face a massive new tax. Perhaps then, some might see the issue here. But probably not. Crushing defeat for the individual today, I'm almost speachless. |

Lets look at this long-term. I think a lot of us think this will become an unmitigated disaster. If we are right, maybe this will eventually lead to the death of the Democratic Party.
I can't wait to see how we are going to pay for this :rolleyes:. In NY we are going to get bombed with the Medicaid expenses. NY is lock to opt-in, but in 5 years when the federal aid runs out, what happens then? BTW, I think everyone should pay close attention to what goes on with the Stock Market now.
