    TRIBUNE-REVIEW
    Tuesday, September 8, 2009

The woman who claims Ben Roethlisberger sexually assaulted her at a Nevada resort has offered to drop her civil lawsuit if he admits that the assault occurred and writes a letter of apology.

The Steelers quarterback also must agree to pay $100,000 to the Committee to Aid Abused Women or some similar entity, according to a letter that the woman's attorney, Calvin Dunlap, wrote to Roethlisberger's lawyers Aug. 31 and submitted to a Nevada court Friday in the latest in a series of court filings in the case.

The woman claims Roethlisberger sexually assaulted her July 11, 2008, at the Harrah's Lake Tahoe Hotel and Casino, where she worked as a VIP concierge and he was attending a celebrity golf tournament. She filed a civil lawsuit in Reno in July of this year.

Roethlisberger, 27, has denied assaulting the 31-year-old woman, who has never gone to police. The Tribune-Review does not name alleged victims of sexual assault.

Dunlap wrote in court documents that he was submitting a copy of his letter to Roethlisberger's attorneys to rebut "unfounded and false suggestions that (the woman) has brought this suit for the purpose of 'extorting' a large monetary recovery."

"Plaintiff's only interest has been and is to regain the dignity that was taken from her," wrote Dunlap, who agreed to waive his fees and costs if Roethlisberger agrees to the settlement.

Roethlisberger's attorneys could not be reached for comment Tuesday night.

Smart woman. There's no way he can take that deal - it would cripple him professionally - but she just erased the "she's just a golddigger out for a payday" defense.

I know you're a lawyer so maybe you can answer this. If this ever winds up in civil court and she loses, can she then "inform the police" and have Ben arrested on criminal charges?

I think she really wants to sue the hotel for preventing her from filing a claim against Ben.

    A letter of apology?

I guess she has no choice since a witness said she bragged about having sex with him.

She should be hung by her ovaries.

I don't buy that at all, If Rothlesberger "admits it took place" then this Reincarnation of Tawanna Brawley/Duke Lacrosse Hooker will turn right around and sue the hotel. This in no way diminishes the amount of money she is looking to get. She is trying to offer Ben a way out that helps her other law suit. There is no way Ben agrees to those terms though..

Absurd. I'm sure he wants to put this behind him, but he can't take that deal.

And BigBensAngel, Vader wasn't framed. He turned evil. Not the best comparison for your starting QB, lol.

Or maybe her case just blew up and she's trying to salvage what little is left of her reputation.

    My thoughts exactly.

She can't just drop charges can she? Say "I was raped", then drop the charges saying "It doesn't matter". That's a form of perjury or wrongful accusation...??

This is a very calculated move on her part; she removes the stigma of being perceived as going after his money, gives the impression of sincerity and puts him in a catch 22 position- donate to the charity and it will be perceived as an admission. Don't donate and it may make him look callous or unsympathetic.

It also may rally that charity's members or its supporters to her cause out of sympathy with the attendant publicity and legal support such organizations may possess.

This is the oldest trick in the world; when you have no case, offer to "settle" so the accused can make it all go away.Hope Ben does to this idea what he normally does to opposing defenses....shreds it.

But she may be trying to play the part of martyr on the cross of women's rights and win the battle of public opinion after she's lost the legal battle. She may still have the capacity to damage his public reputation which, as the NFL has shown, may also have significant penalties for him.

In all probability, any criminal charge has been considered and discarded. Its very hard to prove a rape occurred without any physical evidence that is obtained immediately after the incident. If I'm not mistaken, the police looked into this issue and closed the matter without bringing charges.

There is nothing legally that would prohibit the authorities from revisiting the issue, but from a practical standpoint, its not gonna happen.

    Ben's Lawyers already rejected it...

I think at this point, her move was clearly out of desperation...and most see right through it. The case is completely stacked against her and she is running out of moves.

And, lastly, if she really didnt care about the money, then she wouldnt have thrown in the part about the admission...she knew Ben's lawyers werent going to take the bait, thus the inclusion of the $100,000 donation...it gives an appearance that the money is nothing, when actually it is everything.

btw, i am getting really upset with these high profile rape accuasations that turn out being completely frivolous. Not only are they completely selfish, but they really dont help the perception for any real rape victims. IMO, this women is clearly lying...and should go to jail for a long time.

It's much easier to win a case in civil court as she's only required to show that the proponderence of evidence (50.1%) supports her side of the story.

If she loses in civil court, there's no way she'd be able to convince a trial jury beyond a reasonable doubt that Big Ben slammed her without consent.
