    No charges against Roethlisberger

    MILLEDGEVILLE, Ga. -- Authorities announced Monday that they will not charge [URL="http://sports.espn.go.com/nfl/clubhouse?team=pit"][COLOR=#225fb2]Pittsburgh Steelers[/COLOR][/URL] quarterback [URL="http://sports.espn.go.com/nfl/players/profile?playerId=5536"][COLOR=#225fb2]Ben Roethlisberger[/COLOR][/URL] after a college student accused him of sexually assaulting her at a nightclub last month.
    Ocmulgee Circuit District Attorney Fred Bright said the 20-year-old student's accusations could not be proven beyond a reasonable doubt, and her lawyer said in a letter that she did not want to press charges.

    "Therefore there will be no arrests made nor criminal prosecution against Mr. Roethlisberger," Bright said.

    Bright said the investigation showed the woman was heavily intoxicated that night. She and her sorority sisters had met Roethlisberger at a different bar earlier in the night, and he invited them into a VIP area at the Capital City club and ordered them shots. When the woman walked down a hallway to a small bathroom, Roethlisberger followed her.

    What happened in that bathroom is unclear, Bright said. A doctor who examined the woman could not say if she was raped, and while some DNA was found, there was not enough to determine whom it belonged to.
    "We are not condoning Mr. Roethlisberger's actions that night," Bright said. "But we do not prosecute morals. We prosecute crimes."

    He said local and state investigators spent weeks questioning witnesses even though the woman sent a letter urging prosecutors not to move forward with charges.

    "I know when I have a case and I know when I don't," Bright said. "And I do not have enough evidence to convince 12 jurors beyond a reasonable doubt that Mr. Roethlisberger was guilty of rape."

    Bright said the woman told him it had been an "unnerving experience" and that she and her family made it clear they did not want the matter prosecuted.

    Lee Parks, the woman's attorney, did not immediately comment.
    Roethlisberger was seen out with a few friends at several different bars that night. The Capital City club is a popular spot for students at the neighboring Georgia College & State University. Roethlisberger owns a home about 30 miles north on Lake Oconee, in central Georgia.

    The two-time Super Bowl champ is being sued by a different woman who says he raped her in 2008 at a Lake Tahoe hotel and casino, an allegation he denies. Roethlisberger has not been criminally charged in that case either and has claimed counter-damages in the lawsuit.

    Roethlisberger has not taken part in recent offseason workouts with the Steelers.

    As Pittsburgh's first-round draft pick out of Miami of Ohio in 2004, Roethlisberger led the Steelers to Super Bowl victories in 2006 and 2009. He frequently has donated time and money to charities, and his charitable foundation awards a police dog to a department near every Steelers road opponent.

    But off-field problems have come along with his championships and $102 million contract. In 2006, he defied his coach's orders and rode his motorcycle without a helmet -- and wound up with a concussion, broken jaw and other injuries after a wreck.

    And while Roethlisberger has a reputation for patiently signing autographs and posing for pictures while out in public, he also is known for occasionally inelegant behavior in Pittsburgh.

    Early in his career, he was photographed -- obviously after drinking -- wearing a T-shirt reading "Drink Like a Champion."

    Speaking of Bright's comments, Mortensen said, "You hear him say Ben Roethlisberger provided alcohol to the accuser, the ladies in that group. That a bodyguard escorted the young lady, the accuser, down to the bathroom, and then Ben followed her into the bathroom. I think those facts alone -- as you know, under the personal-conduct policy, you don't need charges, you don't need a conviction.

    "And if Commissioner Goodell is going to factor in an incident at Lake Tahoe more than a year ago, then I would say that Ben Roethlisberger is definitely facing some type of disciplinary action, definitely is going to probably be placed in the substance-abuse program, at the very least. Probably undergo some kind of clinical evaluation, and, I might add, the Pittsburgh Steelers and the Rooney family that owns the club, they are certainly poised to establish some type of disciplinary action against the quarterback."

    Regarding the substance-abuse program, Mortensen didn't say whether this was merely his own speculation or whether he's heard from sources that Roethlisberger is likely to undergo substance-abuse treatment. (It was also a little confusing that Mortensen said both "definitely" and "probably.") The league's substance-abuse program is supposed to be confidential, so if Roethlisberger were to get league-mandated substance-abuse treatment, that fact might never become public.

    But Mortensen believes this is a case the NFL and the Steelers are taking very seriously, despite the fact that no charges will be filed.

    "My gut feeling," Mortensen said, "is there will be some type of suspension."[/I]

    i think the steelers are going to suspend him a few games. ben will definately be on a short leash with the steelers.

    so Rage, how much would it cost me for you to bring a sign to Pittsburgh that calls ben a rapist?????

    Letter from Accusser to D.A.

    [I]The following letter was sent by the attorney representing a woman who accused Ben Roethlisberger of sexual assault to Fred Bright, Ocmulgee Circuit District Attorney:[/I]

    As you know, we represent the complainant in the referenced matter, and it is about that that I write you at this time.

    After a great deal of deliberation, our client has instructed us to advise you that she does not want to prosecute this matter further. While I am well aware that the prosecution decision rests with the Distinct Attorney, and not the complaining party, it is appropriate that you be aware of this fact as you make your decision.

    What is obvious in looking forward is that a criminal trial would be a very intrusive personal experience for a complainant in the situation, given the extraordinary media attention that would be inevitable. The media coverage to date and the efforts of the media to access our client have been unnerving to say the least.

    In short, no matter the outcome of a criminal trial, our client has had sound professional advice since this incident that participating in a public trial would not at all be in her best interest as she goes forward with her life. That is a decision that we, as her attorneys, fully support. As should be clear from what I have said here, this decision does not reflect any recanting of our client's complaint, but simply a realistic, personal decision as to what is in her best interests, and what it would be like to go through a trial with the expected media attention.

    Accuser 'dragged' to room

    A friend of the woman who accused [URL="http://sports.espn.go.com/nfl/players/profile?playerId=5536"][COLOR=#225fb2]Ben Roethlisberger[/COLOR][/URL] of sexual assault told authorities that Roethlisberger's bodyguard "dragged" the woman into a bathroom where the [URL="http://sports.espn.go.com/nfl/clubhouse?team=pit"][COLOR=#225fb2]Pittsburgh Steelers[/COLOR][/URL] quarterback and woman had sexual relations.

    In 572 pages of documents released Wednesday, Nicole Biancofiore told investigators from the Georgia Bureau of Investigations that her friend, a student at Georgia College & State University, "was dragged by a bodyguard to the back room in Capital [City, a local nightclub]. She was extremely intoxicated and not aware of what was happening."

    "He had sex w/me and meanwhile his bodyguards told my friends they couldn't pass them to get to me," the accuser wrote in her statement, which was reported in the Pittsburgh Post-Gazette.

    Later, the accuser said Roethlisberger had sex wiih her in a bathroom adjacent to the VIP room.
    Another friend of the accuser, Aliesha Scholten, told investigators that she tried to open the locked door, but "she was taken away by a bodyguard of Ben's."
    A third friend, Ann Marie Lubatti, told police, that she "approached the other security guard and told him that she [the accuser] was in no shape to be back there with Ben Roethlisberger. He couldn't look me in the eye, and told me he didn't know what was going on. My friend went to open the door, and it was locked."

    The initial police report said that "One of the suspect's bodyguards escorted her to a back room/hallway area where the suspect was. Once there, she stated, the suspect asked her for sex. At this time it is unclear to what happened after this point due to the complainant's recollection being foggy from her intoxication level. However, she did write a statement of what she thought happened."

    [B]In part, the woman's statement read: "I met Ben Rotheseburgehergh [sic] at Velvet [Elvis, a local bar]. He went to the Brick because he was [unreadable] to not be bombarded by fans. He then met us at the Brick and called me 'a tease.' Eventually we saw him at the Capital City & saw him there."[/B]
